Haryana RERA: Provisional Booking Does Not Confer Allottee Status.

No registered agreement, no statutory allottee status, says HRERA.

Haryana Real Estate Regulatory Authority (HRERA) has ruled that merely paying a booking amount and receiving a provisional allotment does not establish a promoter-allottee relationship without a concluded and registered Agreement for Sale (ATS). The authority dismissed a complaint by Neet Rash Consultants against Eldeco Infrastructure and Properties and HSIIDC concerning a unit in the Eldeco Fairway Reserve project, Sector 80, Manesar. In its August 14, 2026 order, HRERA Chairman Arun Kumar noted that although Eldeco had accepted 10% of the sale consideration and issued a provisional allotment letter for unit E1-2201, the complainant failed to execute and register the ATS despite repeated reminders. Eldeco subsequently withdrew the offer and offered a full refund without deductions. HSIIDC maintained that the project land was allotted to Eldeco on an “as is where is” basis, with the existing 66 KV line disclosed in approved plans. HRERA held that the complaint was not maintainable and lacked merit, dismissing all related applications.
