Resolution Paves Way for Smooth Expansion of Bharat Mumbai Container Terminal.

Jawaharlal Nehru Port Authority (JNPA) and Bharat Mumbai Container Terminal Pvt Ltd (BMCTPL), a unit of Singapore’s PSA International, have resolved their long-standing dispute over the container terminal project at JN Port. As part of the settlement, the concession period for the Bharat Mumbai Container Terminal has been extended by 1,173 days beyond the original 30-year term, pushing the new deadline to March 8, 2048, from December 22, 2044. The Conciliation and Settlement Committee (CSC), which mediated the agreement, rejected BMCTPL’s ₹24,044.797 crore damages claim, ruling that delays were caused by force majeure events and not attributable to JNPA. Instead, BMCTPL will refund ₹19.49 crore, including costs for road construction and interest, to JNPA within 15 days of the agreement’s execution. The resolution, hailed as a significant achievement by JNPA Chairman Unmesh Wagh, ensures Phase 2 of the terminal project can progress without further disputes.
