CCI Dismisses Complaint Against Emaar India Over Marbella Villas.
The Competition Commission of India (CCI) has dismissed a complaint against Emaar India Ltd regarding its luxury “Marbella” villa project in Gurugram. The informant alleged that the developer, along with related entities and government departments, violated Sections 3 and 4 of the Competition Act by allowing the construction of builder floors on 97 vacant plots within the project. According to the complaint, the project was originally promoted as an exclusive “Signature Villa Community,” and the addition of non-villa units diluted its exclusivity, breaching commitments made in brochures and agreements. However, the CCI observed that several prominent developers, including DLF, Godrej, Tata Housing, Signature Global, and Vatika, are active in Gurugram’s villa market, providing adequate consumer choice. Therefore, Emaar was not found to hold a dominant position in the relevant market. Without dominance, no case of abuse under Section 4 could be established. Consequently, the complaint was dismissed.
