Tribunal slams “persistent disregard” of environmental orders over illegal garbage facility
NGT Orders Attachment of Gaursons Promoters’ Office, Criminal Action Against MD.
The National Green Tribunal (NGT) has directed the Ghaziabad district magistrate to issue a warrant of attachment against the headquarters of Gaursons Promoters Private Limited for failing to relocate a garbage collection centre, despite clear orders issued over a year ago. The tribunal has also ordered the filing of a criminal complaint against the developer’s managing director under Section 30 of the NGT Act, 2010, which prescribes penalties for non-compliance. The principal bench expressed strong displeasure over the continued defiance of its August 16, 2024, order to shift the organic waste converter (OWC) and garbage centre operating from a residential tower basement in Gaur City 2, Greater Noida. The case arose from a petition by a resident alleging foul smell and health risks. Noting the absence of compliance reports and non-appearance of key officials and the developer, the NGT warned authorities against a “casual approach” to judicial orders. It underlined that NGT directives carry the force of a civil court decree and are enforceable through attachment of property and other coercive measures.
