Homebuyers can challenge illegal fees through Form-M on the e-court portal.

UP-RERA Allows Online Complaints Against Excessive Transfer Charges by Builders.

The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has enabled an online mechanism for homebuyers and allottees to file complaints against promoters demanding transfer charges beyond prescribed limits. The facility is available through Form-M on the UP-RERA portal under its e-court system, following the implementation of the 10th amendment to the UP-RERA General Regulations, 2019. As per the amended Regulation 47(c), promoters are no longer permitted to execute a new or revised agreement for sale or lease during transfer. Instead, transfers must be recorded through an endorsement in the existing agreement along with updates in the promoter’s records. In cases involving transfer to a family member or succession after the death of an allottee, the processing fee is capped at ₹1,000. For non-family transfers, the maximum permissible fee is ₹25,000. Any demand exceeding these limits can now be challenged online, strengthening consumer protection and transparency in real estate transactions.
